In August 2000, the Fen Phen Settlement Trust was approved to compensate victims who underwent surgery for heart valve replacement or primary pulmonary hypertension (PPH) after taking Fen Phen. The trust was established to administer all claims and benefit payments to Fen Phen victims who registered as part of the Nationwide Class Action Settlement Agreement with American Home Products Corporation (AHP). What’s the problem?
Although Fen Phen, Redux and Pondimin were recalled at the request of the U.S. Food & Drug Administration (FDA) in 1997, consumers are still suffering from the damages caused by the drugs. These Fen Phen products have been found to cause catastrophic heart valve damage and a potentially-deadly condition known as primary pulmonary hypertension (PPH) or pulmonary arterial hypertension (PAH). A Philadelphia federal court approved a class action settlement that oversees the current rights of consumers injured by Fen Phen products.
Future legal claims for Fen Phen-induced injuries are now barred unless the patient registered with the American Home Products Settlement Trust. American Home Products was the name of the manufacturer who made Fen Phen, Redux and Pondimin. The company has since changed its name to Wyeth Pharmaceuticals.
Those individuals who have properly registered are eligible to claim benefits under the terms of the class action settlement through December 31, 2011. Even if you were compensated through the settlement trust, you can apply for additional settlement payments if your condition gets worse or if you need heart valve surgery. Please note: lawsuits by individuals diagnosed with Fen Phen-induced primary pulmonary hypertension are not barred by the settlement agreement. PPH is an extremely serious condition that can take years to be conclusively diagnosed. According to the settlement agreement, these claims are governed by the state statutes of limitations from the time of full diagnosis of the disease. Even now, nearly 15 years after Fen Phen products were pulled off the market, former users continue to contract these diseases which are likely to have been caused by Fen Phen. Fen Phen Medical Studies
A 2008 study published in the medical journal BMC Medicine found that a number of patients had significant heart damage that appeared much later – up to seven years after last taking Fen Phen. Charles Dahl, the lead researcher of the study, commented on the strong association between Fen Phen products and heart damage:
“Valve problems were common in individuals exposed to fenfluramines, more frequent in females, and associated with duration of drug use in all valves assessed. We found clear evidence for a strong, graded association between duration of exposure to fenfluramines and prevalence of aortic regurgitation and for mild or greater mitral and tricuspid regurgitation.”
Dahl went on to say that his study probably yielded very conservative estimates, as other research has indicated a 17 to 34-fold increase in heart valvular disease in patients who took Fen Phen for a period of four months or longer.
Am I Eligible to be Compensated by the Fen Phen Settlement Trust?
You may be eligible to receive additional compensation through the Fen Phen Settlement Trust if you underwent an aortic or mitral valve replacement surgery after you settled your initial Fen Phen injury lawsuit. The following High Matrix Level Qualifying Factors may allow you to participate in this trust fund (depending on the condition, prior registration may or may not be required):
- the patient underwent surgery to repair or replace a heart valve
- the patient was diagnosed with primary pulmonary hypertension or pulmonary arterial hypertension (prior registration is not required)
The deadline for being eligible to be compensated by the Fen Phen Settlement Trust is December 31, 2011. In order to qualify, the health conditions listed above must be diagnosed earlier than December 31, 2011, or 15 years from your last use of Fen Phen, Pondimin (Fenfluramine), or Redux (Dexfenfluramine). If you feel you may be eligible, we encourage you to take the following steps as soon as possible:
- evaluate your current health status;
- consider the possibility that potential side effects from these drugs may have worsened over time;
- if a loved one has died as a result of taking Fen Phen, you should review their records and ensure that compensation has been made or will be made before December 31, 2011.
